Terms and Conditions
This Terms of Service Agreement states the terms and conditions that must be followed by any one using this service. By signing up for an account with magicgenie.co.uk, you the user, agree to these terms and conditions. If you do not accept the terms of this agreement, do not complete the registration process. The provider of these services does reserve the right to make amendments to the Terms of Service Agreement. This can be done at any time without prior notice, as long as the updated Terms of Service Agreement is made available to the user through the web site, and that the user can terminate their obligations under this agreement by deleting their account if they do not agree to the provisions made to the agreement. 1. Services magicgenie.co.uk offer a variety of Internet services. These are Website hosting, email hosting. However we do not offer background processes such as daemon servers and applications such as IRC, IRC bots, rc5des, Egg drops, Java Chat Server, etc. magicgenie.co.uk reserves the right to delete or modify any services, fees, conditions of service and the terms of this User Agreement at any time. If at all possible, the provider will provide a (30) day notice to users before any changes are made. b. Cancellation This agreement is effective as soon as the user clicks the "I AGREE" button and continues until either the user or the provider terminates the contract under the following circumstances:
The provider of these services can terminate a user's account at any time if they breach any part the this Agreement or if it is necessary for security reasons to suspend the user's service, if the user has used the service for an unlawful act or if they fail to make payments. If the provider must terminate the Agreement for just cause, the user will still be liable for the full monthly charge for the month in which their account is terminated. Termination by the user. The user may cancel their account by contacting customer service. The user will still be liable for fees for the rest of the month in which they cancel services. 2. Rules governing content and use of services The provider may terminate the user's accounts if they violate the guidelines set forth in this agreement. By signing up for services the user agrees not to do or participate in any of the following: Not to have content that contains or contains links to extreme violence or material that is otherwise objectionable and offensive. There will be no content which is racially or ethnically offensive. Content cannot harass or harm another individual. There will be no hacking, sending viruses, setting up harmful code or other acts which could harm the Providers system or any others There will be no spamming and sending unsolicited emails by using the providers services. There can be no content which provides, sells or promotes any of the following: illegal drugs and drug paraphernalia, stolen merchandise, information about making illegal or obtaining illegal weapons. The content of user's sites will not be actively monitored. However, the provider does reserve the right to investigate any complaints of violations of the Terms of Services. magicgenie.co.uk do allow adult material to be stored on the servers. However illegal pornography including child, beastality or others similar to this are not allowed. If any of this material is found your account terminated and no refund will be given. Services and Reliability magicgenie.co.uk do back up data on a daily basis. Hower the user is responsible for creating backups of their own files. They agree to use the provider's resources at their own risk. The provider does not guarantee that its security procedures will prevent the loss of, alteration of, or improper access to the users files. Liabilities The user is solely responsible for the conduct of the all their own business and matters. The provider is not liable to the user in any way for the loss of any data, goods, revenue, profits, services or technology. The provider is not responsible for any punitive damage if this should occur. Therefore the user waives any claims against the provider for any such issues arising from the use of the providers services. . The provider's rights a. user Files and Accounts The provider reserves the right to delete users accounts when they breach the Terms of Services Agreement. The provider will not be held responsible for any consequences of the deletion of the account. b. Proprietary Rights The PROVIDER retains all proprietary rights, including, but not limited to, services, technology, all content, text, design, graphics, sound, and so forth on its Web sites. The USER acknowledges that all content and technology available on the PROVIDER sites is protected by U.K. and international copyrights, trademarks, service marks, patents, or any other proprietary rights and laws and that the USER is permitted to use content and . b.. Trademarks and Servicemarks The providers graphics and logos, are the trademarks of the provider. The user agrees not use any of the provider's trademarks.
Closing of this Agreement By signing up for services provided by magicgenie.co.uk, the user agrees to and accepts all policies set forth in this Agreement.
